1. Acceptance of Terms

By accessing and using App Discount ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Description of Service

App Discount is a multi-vendor marketplace that connects software vendors and consumers through:

  • Direct marketplace sales with vendor partnerships
  • Official group buying collaborations for exclusive discounts
  • Curated software recommendations and discovery

3. Compliance with Regional Laws

We comply with applicable regional data protection and consumer laws:

  • GDPR (European Union): Full compliance with data protection requirements
  • CCPA (California): Consumer privacy rights and data protection
  • CalOPPA (California): Online privacy protection requirements
  • PIPEDA (Canada): Personal information protection standards
  • UK GDPR (United Kingdom): Post-Brexit data protection compliance

4. User Accounts

4.1 Account Creation

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • One person or legal entity may maintain no more than one account
  • You must be at least 18 years old to use this service

4.2 Account Responsibilities

  • You are responsible for all activities under your account
  • You must immediately notify us of any unauthorized use

5. Purchases and Payments

  • We accept major credit cards and supported payment methods

5.3 Group Buying Terms

  • Participation in group buying requires upfront payment
  • Refunds are automatically processed when higher discount tiers are reached
  • Once joined, you cannot withdraw from an active group buy
  • Full refunds may be requested only after the group buy ends

6. Vendor Terms

6.1 Vendor Eligibility

  • Vendors must provide legitimate software products
  • All products must have proper licensing and authorization
  • Vendors must maintain accurate product information

6.2 Commission Structure

  • Platform commission rates are agreed upon during onboarding
  • Settlements are processed according to vendor agreements
  • Vendors are responsible for their own tax obligations

7. Intellectual Property

7.1 Platform Content

  • All platform content is protected by copyright and other laws
  • You may not reproduce, modify, or distribute our content without permission

7.2 User Content

  • You retain rights to content you submit
  • You grant us a license to use your content for platform operations
  • You are responsible for content you post

8. Prohibited Uses

You may not:

  • Use the platform for any illegal purpose
  • Violate any laws in your jurisdiction
  • Transmit malware or harmful code
  • Attempt to gain unauthorized access to our systems
  • Engage in fraud or misrepresentation
  • Spam or harass other users
  • Scrape or copy platform content without permission

9. Disclaimers

9.1 Service Availability

  • We do not guarantee uninterrupted service availability
  • We may modify or discontinue services with notice
  • We are not responsible for third-party service interruptions

9.2 Product Warranties

  • Software products are provided by third-party vendors
  • We do not warrant vendor products or services
  • Vendor warranties and support are separate from our platform

10. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to amounts paid to us in the past 12 months
  • These limitations apply regardless of legal theory

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from:

  • Your use of the platform
  • Your violation of these terms
  • Your violation of any third-party rights

12. Privacy

Your use of our platform is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs the site and informs users of our data collection practices.

13. Dispute Resolution

13.1 Governing Law

These terms are governed by the laws of Delaware, United States, except for users in specific jurisdictions:

  • Canadian users: Laws of the Province of Ontario, Canada
  • EU users: Laws of the user's country of residence
  • UK users: Laws of England and Wales

13.2 Arbitration

Any disputes shall be resolved through binding arbitration in accordance with:

  • US users: American Arbitration Association rules
  • Canadian users: ADR Institute of Canada rules
  • EU/UK users: Arbitration is optional; users retain the right to bring claims in local courts

13.3 Class Action Waiver

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these terms.
